Within this agreement, “Student” represents both students receiving musical instruction, and the parent/guardian responsible for student.
Cancellations and Rescheduling
Rescheduling and Cancellations are honored, and in most cases, with 24-hour advanced notice, your instructor is likely to be able to reschedule your lesson. However, because our instructors balance multiple students’ schedules, if a cancellation or rescheduling occurs inside 24 hours of your lesson, your lesson credit may be subject to charge.
Open-Door Policy
At Music By Ross, safety is our #1 concern, and we want to ensure that both our students, and our instructors, are practicing habits that promote the best possible learning environment. That is why we ask that all Music By Ross lessons to be conducted in an open room, or with the entry (doorway) to the room open. Remember that all MBR instructors are background checked in the hiring process.
Unused Lessons
Most students take lessons on a weekly basis, except for normal cancellation and rescheduling situations. At Music By Ross, there is no expiration for your lessons week-to-week, or month-to-month. After you purchase your lesson(s), you are free to use them at your unique learning pace. However, if your account displays inactivity for over one year, your remaining lessons will be charged. Furthermore, refunds for remaining lesson credits require 30-day notice, and will be refunded at a 50% of original purchasing price.
Instructor Reassignment
All Music By Ross music teachers are put through a thorough certification process to ensure that you are receiving the best, and most qualified, local music instructor. We are confident that you will be 100% satisfied with your lessons, and your teacher. In the rare event you feel that a different instructor could be a better fit for you or your child’s goals, we will be glad to assign you a different instructor at no extra cost. Your remaining lessons credit will transfer and the new instructor will be happy to pick up where you left off!
Discrimination and Harassment
Music By Ross has a strong policy against any form or type of discrimination and harassment by, among, or to its representatives. Discrimination and harassment can be defined as any behavior that is disrespectful and causes discomfort to another person, be it physical, verbal, visual, or sexual. Student understands that Music By Ross instructors are sub-contracted, and Instructors are responsible for their own actions/conduct, and must never engage in discrimination and harassment.
Liability
Student shall indemnify, hold harmless and defend Music By Ross/PoppyField, LLC, from and against any and all costs, expenses (including reasonable counsel fees), liabilities, losses, damages, suits, actions, fines, penalties, claims or demands of any kind arising out of or in any way connected with, Student’s music lessons and/or Student’s Instructor. Music By Ross/PoppyField, LLC and it’s instructors shall not be liable to students on account of any accident, death or personal injury, or damage to or loss or theft of property, which shall occur while participating in music instruction.
In the event of any legal action between the parties arising under or relating to this Agreement, the costs, expenses and attorneys’ fees incurred by the prevailing party including, but not limited to, the costs, expenses and attorneys’ fees incurred in pursuing any appeal and collecting any judgment, shall be assessed against the other party in such action. If any such action involves both claims and counterclaims, and if each party shall have judgment rendered in its favor on one or more such claims or counterclaims, the party whose total judgments in such action is greatest shall be deemed the prevailing party for purposes of this Section.
Student’s Instructor
Music By Ross/PoppyField, LLC and it’s instructors shall not be liable to students on account of any accident, death or personal injury, or damage to or loss or theft of property, which shall occur while participating in music instruction.

Consideration
Student agrees to pay the negotiated fees (prepaid) in consideration of musical instruction provided Music By Ross. Rates may be subject to change within reason as a result from natural rate of inflation and/or service costs.
Agreement
I have read, and agree to be bound by the terms and conditions of this agreement for private music instruction through the Music By Ross/PoppyField, LLC. I fully understand that by accepting services offered by Music By Ross and their instructors, performed either in my home, or alternate location, that I agree to the terms stated in this Agreement. I also fully understand that Music By Ross is an independent agent and that failure to abide by this contract will result in termination of this agreement and agreement between both student and Music By Ross parties will be revoked immediately.
